Fibre contractor dispute results in liens on homes St Albert

"The liens are in process of being removed," Copperline Excavating president Jamie Black said in a written statement to CBC News Wednesday. "Ledcor and Copperline have resolved this matter." Telus is upgrading its fibre optic service across the province. The work in St. Albert was contracted to Ledcor, which subcontracted work to Copperline Excavating, a Spruce Grove company. .... one of the homeowners caught up in the dispute. When initially reached by CTV News Edmonton, Copperline Excavating said the liens were filed against the utility right of way on those properties because the company says it was not paid by Ledcor. .... Hours later, TELUS said the three residents selling their properties had their liens removed. Tribe confirmed to CTV News Friday night, the lien was lifted. There is not a 'utility right of way' on private property. There is a 'utility access path' (from lot line to building). A 'utility right of way' on private property would be on a registered easement (one or more types: in-ground, in-air, on-surface). Legal definitions are fun. Multi-dwelling properties will be defined slightly differently, with the Telco/Powerco having access from street to the utilities room before spreading out to all units on the property. What a freaking mess. When registering a lien, a person needs to understand the part about 'I declare that all stated in this document is 100% the truth, under penalty of perjury.'
